Consent to the Collection and Processing of Personal Data
- For the purpose of obtaining a microloan from me, as well as its subsequent servicing, in the event of concluding a microloan agreement with me, I hereby provide LLP “MFO CreditFlow” (hereinafter – MFO), BIN 241240018040, with my consent to the processing of all my personal and biometric data listed below, in accordance with the legislation of the Republic of Kazakhstan on personal data. This includes performing any action (operation) or a set of actions (operations) using automated means or without using such means with my personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access) to third parties (including legal entities) that, in the opinion of the MFO, may be involved in providing me with a microloan and/or its subsequent servicing and/or collection, as well as to other mobile operators, for the purpose of providing MFO with verification data, including cross-border transfer.
- The list of personal data for which consent is given for collection, processing, and storage includes data voluntarily provided by the Borrower to the MFO, including during registration on the MFO Website (by completing this Form), including: surname, first name, patronymic; gender; date and place of birth; identity document details; IIN; place of residence and its legal basis (rental agreement or ownership); marital status; number of children; ownership of a vehicle; vehicle registration number (if applicable); education level; type of employment; monthly income; date of next salary; region of residence; actual address; registration address; duration of residence at the current address; phone number; home phone number, including contacts (if provided); work phone number (if available); email; data obtained by MFO from third parties based on the consent provided by me; biometric data: photograph.
- Personal data shall be stored for the periods established by law. Personal data shall be destroyed upon achieving the purposes of data processing; in the event of liquidation or reorganization of the MFO, if there is no legal successor; based on a written request by the data subject to terminate the processing of their personal data, if the microloan agreement was not concluded, or in the case of a concluded microloan agreement, based on the grounds listed in the Agreement.
- I also confirm that I have been informed by the MFO about the protection of personal data of the MFO subject in a manner similar to the protection of information constituting the confidentiality of microloan provision, unless otherwise required by the legislation of the Republic of Kazakhstan. In the event that, as a result of concluding relevant agreements between the subject (or the representative of the subject) and the MFO, my personal data is/shall be transmitted via open communication channels, including cross-border transfer, I acknowledge the risk of unauthorized access by third parties and accept this risk.
- This consent may be provided to third parties as evidence that consent to the collection and processing of personal data of the subject has been granted by me.
- The Borrower agrees to the use of their personal data for the purpose of concluding this Microloan Agreement and its subsequent servicing, or refusal to grant a microloan, as well as for subsequent collection through judicial or pre-judicial procedures in case of the Borrower’s default under the Agreement. The Borrower consents to the use of all their personal data by the MFO until the full and proper fulfillment of their obligations under the Microloan Agreement. The Borrower is informed of the possibility to withdraw consent by submitting a written request to the MFO. At the same time, the Borrower agrees that the MFO has the right to continue processing personal data after receiving the withdrawal request: – until the completion of the relevant service/operation/payment; – until the fulfillment of the Microloan Agreement; – if continued processing is required by applicable law (in which case processing is carried out to the extent necessary to comply with legal requirements) or MFO internal regulations.
